SEC releases updated Marketing Rule FAQs

      On January 11th, 2023, the SEC released an FAQ with responses to questions related to the adoption of amendments to the Marketing Rule, Rule 206(4)-1 under the Investment Advisers Act of 1940.

      The FAQ clarifies requirements around the compliance date (November 4th 2021), the time period requirement for displaying performance results and gross and net performance obligations for one investment or a group of investments. The SEC expects to update this FAQ document from time to time to include responses to additional questions.
